These Terms of Use ("Terms") govern the use of Fanver.io and all services provided through the platform.

By creating an account, uploading or downloading content, purchasing a paid plan, participating in the affiliate program, or otherwise using Fanver.io, you agree to these Terms.

1. Service Provider

Hereinafter referred to as "Fanver", "we", "us", or "our".

2. Description of the Service

Fanver provides an online file hosting and sharing service.

Depending on the features and plan available to a user, Fanver may allow users to:

upload and store files;

generate links for sharing or downloading files;

manage uploaded files through a user account;

share content with other users or third parties;

access free or paid storage and platform features;

download files made available by other users;

participate in the Fanver affiliate program;

use additional features made available by Fanver from time to time.

The exact functionality, storage limits, file size limits, bandwidth limits, and other features may depend on the user's selected plan.

We may develop, modify, add, or discontinue features where reasonably necessary, taking into account the legitimate interests of our users.

3. Registration and User Accounts

Certain features require a Fanver account.

Users must provide accurate and up-to-date information when registering and must keep their account information current.

Users are responsible for maintaining the confidentiality and security of their login credentials and for activities carried out through their account where attributable to them.

Accounts may not be sold, transferred, rented, or made available to third parties without our permission.

If you suspect unauthorized access to your account, you should contact us immediately at support@fanver.io.

Fanver may offer registration and authentication through third-party services such as Google Sign-In.

4. Eligibility

You may only use Fanver if you are legally capable of entering into the relevant agreement under the laws applicable to you.

If you are a minor, you may use Fanver only to the extent permitted by applicable law and, where required, with the consent of your parent or legal guardian.

You must not use Fanver if applicable law prohibits you from receiving or using the service.

5. User Content

"User Content" means files, images, videos, documents, archives, or other content uploaded, stored, transmitted, or shared by users through Fanver.

You retain ownership of your User Content.

Uploading content to Fanver does not transfer ownership of that content to us.

However, you grant us a limited, non-exclusive right to host, store, reproduce, transmit, cache, technically process, and make your User Content available to the extent necessary to operate Fanver and provide the features requested by you.

This permission exists only to the extent necessary to provide, secure, maintain, and operate the service and ends when the content is deleted, except where continued storage or processing is required by law or technically necessary for a limited period.

6. Responsibility for Uploaded Content

Users are responsible for the content they upload, store, and share through Fanver.

By uploading or sharing content, you represent that:

you have the necessary rights or authorization to use the content;

your use of the content does not unlawfully infringe third-party rights;

storing or distributing the content is permitted by applicable law;

the content does not violate these Terms.

Fanver does not generally pre-screen every file uploaded by users.

The availability of content through Fanver does not mean that Fanver endorses, approves, or accepts responsibility for that content.

7. Prohibited Content

Fanver must not be used to upload, store, distribute, promote, or make available illegal content or content that violates these Terms.

Prohibited content includes, in particular:

child sexual abuse material (CSAM) or sexual content involving minors;

content depicting, promoting, facilitating, or exploiting the sexual abuse of children;

non-consensual intimate images, recordings, or sexually explicit material;

content unlawfully infringing copyrights, trademarks, or other intellectual property rights;

malware, viruses, ransomware, spyware, malicious scripts, or other harmful software;

phishing pages, credential theft tools, or content intended to obtain information fraudulently;

content used to facilitate fraud, scams, identity theft, or other criminal activity;

illegal terrorist content;

content whose possession, publication, or distribution is prohibited by applicable law;

content that unlawfully violates another person's privacy, data protection rights, or personal rights;

stolen or unlawfully obtained personal, financial, authentication, or confidential information;

content used to threaten, extort, blackmail, or unlawfully harass another person.

This list is not exhaustive.

Content may also be restricted where its storage or distribution creates a serious security risk or violates other applicable legal requirements.

8. Prohibited Use of the Service

You must not misuse Fanver.

In particular, you must not:

attempt to gain unauthorized access to Fanver, another user's account, servers, systems, or networks;

circumvent storage, bandwidth, download, security, advertising, or account restrictions;

interfere with or disrupt the operation of Fanver;

distribute malware or malicious code;

use automated systems, bots, scrapers, or similar technology in a manner that places an unreasonable load on our infrastructure;

manipulate downloads, impressions, advertising interactions, affiliate tracking, referrals, or statistics;

artificially generate advertising impressions or clicks;

use Fanver to send spam or unsolicited bulk communications;

impersonate another person or organization;

use Fanver for fraudulent or deceptive purposes;

create multiple accounts primarily to circumvent restrictions, suspensions, limits, or payment obligations;

attempt to bypass content restrictions or enforcement measures.

9. Sharing and Download Links

Fanver may allow users to create links through which files can be accessed or downloaded.

Users are responsible for deciding who receives their sharing links.

Depending on the selected sharing settings, anyone who obtains a link may be able to access the corresponding file.

You should therefore not share confidential, personal, sensitive, or private information through publicly accessible links unless you are authorized to do so and understand the consequences.

Fanver cannot guarantee that a sharing link will remain private after it has been provided to another person.

We may disable sharing or download links where necessary to enforce these Terms, comply with legal obligations, protect our systems, or respond to valid reports.

10. Downloads

Files available through Fanver are generally uploaded and provided by users.

Users download third-party files at their own discretion.

We do not guarantee that every user-uploaded file is accurate, safe, suitable, or free from harmful components.

Users should take appropriate security precautions when downloading and opening files obtained from third parties.

Nothing in this section limits liability where such limitation would be prohibited by applicable law.

11. Reporting Illegal or Infringing Content

If you believe that content available through Fanver is illegal or infringes your rights, you can report it to:

support@fanver.io

Please provide, where possible:

the exact URL or download link;

an explanation of why you believe the content is illegal or infringes your rights;

information sufficient to identify the affected content or protected work;

your contact information where required;

any additional information reasonably necessary to assess the report.

12. Content Moderation and Removal

We may investigate content or accounts where we receive a report, identify potential abuse, detect security risks, or otherwise become aware of a possible violation.

Where appropriate and permitted by law, we may:

restrict access to content;

disable sharing or download links;

remove content;

restrict particular account functions;

temporarily suspend an account;

permanently terminate an account;

take technical measures against repeated abuse.

We will take applicable legal requirements, the nature and severity of the violation, and the rights and legitimate interests of affected users into account.

Where required by applicable law, affected users will receive information about relevant moderation decisions and available options to contest them.

13. Serious Illegal Content

Where we become aware of content that may constitute a serious criminal offence involving a threat to the life or safety of persons, we may take the actions required under applicable law, including cooperation with competent authorities.

Where legally required, relevant information may be preserved or disclosed to competent authorities.

14. Repeated Violations

Users who repeatedly provide manifestly illegal content or repeatedly violate these Terms may have their use of Fanver restricted or terminated.

We may also take appropriate measures against persons who repeatedly submit manifestly unfounded reports or complaints.

Any such decision will be made in accordance with applicable law and with consideration of the circumstances of the individual case.

15. Free Services

Fanver may provide certain services free of charge.

Free accounts may be subject to limitations relating to:

storage capacity;

file size;

bandwidth;

download speed;

file retention;

advertising;

functionality;

number of files;

other technical limitations.

The applicable limits are displayed on Fanver or as part of the relevant plan description.

We may reasonably modify free services or their limits, particularly for technical, security, economic, or abuse-prevention reasons.

16. Paid Plans

Fanver may offer paid subscriptions or other paid services.

The price, billing interval, included features, storage capacity, and other relevant conditions are displayed before purchase.

Unless otherwise stated, prices shown to consumers include applicable taxes where legally required.

Where the German small business regulation under Section 19 of the German VAT Act (UStG) applies, VAT is not separately charged or shown.

17. Payments

Payments are processed using Stripe or another payment method displayed during checkout.

By purchasing a paid service, you agree to provide accurate billing and payment information.

Payment information may be processed directly by the relevant payment service provider.

If a payment fails, is reversed, charged back, or remains outstanding, we may restrict access to paid functionality after providing any notice required by law.

18. Subscriptions and Renewal

Where a paid plan is offered as a subscription, the applicable billing interval and renewal conditions will be shown before purchase.

If automatic renewal applies, the subscription will renew according to the conditions disclosed during checkout unless it is cancelled in accordance with the applicable cancellation procedure.

Users can cancel subscriptions using the cancellation options provided through Fanver or by contacting us where applicable.

Cancellation prevents future renewal but does not automatically entitle the user to a refund for an already commenced billing period unless required by applicable law or expressly agreed otherwise.

19. Consumer Rights

If you are a consumer residing in the European Union or another jurisdiction providing mandatory consumer rights, those rights remain unaffected by these Terms.

Where a statutory right of withdrawal applies to a paid service, we will provide the legally required information during the ordering process.

Where you expressly request that the provision of a digital service begins before the expiry of a statutory withdrawal period, the legal consequences applicable to such a request will be communicated during checkout where required.

Nothing in these Terms excludes mandatory consumer protection rights.

20. Refunds

Refunds are provided where required by applicable law or where expressly stated as part of a specific Fanver offer.

The absence of use of a paid account does not by itself create a right to a refund.

Mandatory statutory rights remain unaffected.

21. Changes to Prices and Paid Plans

We may change prices or the features of paid plans for future billing periods.

Where an existing subscription is materially affected, users will receive reasonable advance notice where required.

Price changes will not retroactively alter amounts already paid for a completed billing period.

Users may cancel an affected subscription before a price change takes effect in accordance with the applicable cancellation terms.

22. Affiliate Program

Fanver may operate an affiliate or referral program.

Eligible participants may receive commissions for referring customers or users in accordance with the conditions displayed for the affiliate program.

Affiliate participants must not:

generate fake or self-referrals where prohibited by the program;

create fraudulent accounts or transactions;

manipulate tracking or attribution;

use bots or automated traffic to generate referrals;

generate artificial clicks or conversions;

engage in misleading advertising;

impersonate Fanver;

send unlawful spam;

use Fanver trademarks or branding in a misleading manner;

bid on protected brand terms where expressly prohibited by the applicable affiliate conditions;

otherwise manipulate the affiliate system.

We may withhold commissions associated with fraudulent, cancelled, refunded, charged-back, or otherwise invalid transactions.

In cases of suspected abuse, payment of affected commissions may be temporarily suspended while the matter is investigated.

Serious or repeated violations may result in termination from the affiliate program.

23. Affiliate Payments

Affiliate commissions are calculated according to the commission structure displayed in the affiliate area or otherwise agreed with the participant.

Participants are responsible for providing accurate payment information.

Affiliate participants are responsible for their own tax obligations arising from commissions received through the program.

We may request information reasonably necessary to verify an affiliate participant or satisfy legal, tax, fraud-prevention, or payment requirements.

24. Advertising

Fanver may display advertising, including advertising on download pages.

Users must not artificially generate or encourage invalid advertising impressions, clicks, or interactions.

The use of automated systems, misleading incentives, click manipulation, or other methods intended to improperly generate advertising revenue is prohibited.

Fanver may restrict or terminate accounts involved in advertising fraud or similar abuse.

25. Storage and File Deletion

Storage limits and file retention rules may vary depending on the selected plan.

Users are responsible for maintaining their own backup copies of important files.

Fanver should not be used as the sole storage location for irreplaceable data.

Files may be deleted where:

the user deletes them;

an applicable retention period expires;

the account or plan no longer provides the necessary storage;

the account is terminated;

the content violates these Terms;

removal is required by law;

continued storage creates a security or technical risk.

Where reasonably possible and legally appropriate, we may provide notice before deleting content due solely to changes in account status or storage limits.

26. Availability and Maintenance

We aim to provide a reliable service but do not guarantee uninterrupted or error-free availability.

Temporary interruptions may occur due to:

maintenance;

software updates;

security incidents;

technical failures;

infrastructure problems;

third-party service failures;

events outside our reasonable control.

Where reasonably possible, planned maintenance that materially affects the service will be carried out in a manner intended to minimize disruption.

Mandatory statutory rights remain unaffected.

27. Third-Party Services

Fanver uses third-party infrastructure and services, including hosting, cloud storage, payment, authentication, advertising, email, and security providers.

The availability of some Fanver functionality may therefore depend on third-party services.

The processing of personal data in connection with these providers is described in our Privacy Policy.

28. Intellectual Property of Fanver

The Fanver name, website, design, software, logos, graphics, and other materials created or owned by Fanver are protected by applicable intellectual property laws.

Unless expressly permitted, users may not copy, reproduce, distribute, modify, sell, license, or commercially exploit Fanver's protected materials.

These restrictions do not apply to User Content owned by users.

29. Copyright Complaints

Rights holders may report allegedly infringing files to:

support@fanver.io

A report should identify the protected work, the allegedly infringing content, the relevant Fanver URL, and the basis on which the reporting party believes that the use is unauthorized.

We may request additional information where reasonably necessary to assess a complaint.

30. Termination by Users

Users may stop using Fanver at any time.

Registered users may delete their account using available account functionality or request account deletion by contacting support@fanver.io.

Deleting an account may result in the permanent deletion of files and other information associated with the account, subject to statutory retention obligations and legitimate technical or security requirements.

Users should download any files they wish to retain before deleting their account.

31. Termination or Restriction by Fanver

We may restrict, suspend, or terminate access to Fanver where there is a valid reason, including:

serious or repeated violations of these Terms;

illegal activity;

fraud or attempted fraud;

security threats;

abuse of our infrastructure;

non-payment of amounts due;

legal or regulatory requirements.

The severity and duration of any restriction will be proportionate to the circumstances where required by law.

Mandatory notification, explanation, and complaint rights remain unaffected.

32. Liability

Fanver is liable without limitation where liability is mandatory by law, including for intent and gross negligence and for injury to life, body, or health caused by a culpable breach of duty.

In cases of slight negligence, Fanver is liable for breaches of essential contractual obligations only to the extent permitted by law. In such cases, liability is limited to the foreseeable damage typical for the contract.

Essential contractual obligations are obligations whose fulfilment is necessary for the proper performance of the agreement and on whose fulfilment the user may regularly rely.

The statutory provisions remain applicable in all other respects.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

33. User Responsibility and Indemnification

Users are responsible for violations of law or third-party rights caused by content or activities attributable to them.

Where permitted by applicable law, a user may be required to compensate Fanver for reasonable losses or expenses resulting from culpable violations of these Terms or third-party rights.

This does not apply where the user is not responsible for the relevant violation.

34. Privacy

Our processing of personal data is governed by our Privacy Policy.

By using Fanver, you acknowledge that personal data is processed as described in the Privacy Policy and in accordance with applicable data protection law.

35. Changes to These Terms

We may update these Terms where there is a valid reason, for example due to:

changes in applicable law;

regulatory requirements;

security requirements;

changes to Fanver's functionality;

introduction of new services;

technical developments.

Where a change materially affects an existing contractual relationship, we will provide reasonable advance notice where required by law.

Mandatory user rights relating to contractual changes remain unaffected.

36. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany.

For consumers, this choice of law does not deprive you of mandatory consumer protection rights that apply under the laws of the country in which you have your habitual residence.

37. Jurisdiction

Where the user is a merchant, a legal entity under public law, or a special fund under public law, the competent courts in Germany shall have jurisdiction to the extent permitted by law.

Mandatory statutory rules regarding jurisdiction for consumers remain unaffected.

38. Severability

If any provision of these Terms is or becomes invalid or unenforceable, the validity of the remaining provisions will not be affected.

The applicable statutory provisions shall apply in place of any invalid provision.
